Terms & Conditions
Agency
For the purposes of these Terms and Conditions, the bride and groom, any purchaser from their wedding list (a "Guest") and WPD agree that except as specifically stated herein, the bride and groom shall act as the Guest's agent in respect of any rights the Guest may have as a result of their purchase of a gift from the relevant wedding list.
Wedding List
- All orders are immediately marked as having been sold from the list but in the event of any duplication (except in relation to orders through WPD's Online Shopping service) WPD will offer an alternative choice. WPD has no responsibility if a gift purchased through WPD is duplicated by purchase of the same gift via another source.
- WPD shall be entitled to follow the written or oral instructions of either the bride or the groom. WPD can only accept alterations or deletions to a wedding list from the bride and groom themselves in writing.
- WPD reserves the right to refuse to accept a wedding list booking if any minimum level of order agreed with the bride and groom is not reached or for such other reasons as they may deem appropriate.
- If a supplier to WPD withdraws goods for sale, WPD may remove such goods from the wedding list. In such circumstances, WPD will where possible advise the bride and groom and offer them an opportunity to select alternative goods.
- WPD reserves the right to charge a fee of £30.00 for the cancellation of a meeting in our showroom if cancellation is made within 24 hours of the time of the meeting.
On-line Shopping
- The following provisions apply to the purchase of goods by a purchaser (the "Purchaser") from WPD online other than pursuant to a wedding list ("Online Shopping"). Except as otherwise stated, all the provisions set out in these terms and conditions shall apply equally to Online Shopping amended, where necessary, as appropriate.
- Orders will only be accepted when paid for in full.
- WPD will not be responsible for the duplication of any present bought
- through its Online Shopping service.
Payment
- WPD accepts payment by cheque as well as most major credit and debit cards.
- All prices quoted are in pounds sterling including VAT, except where otherwise stated.
- Except as specifically noted, our wedding list service is free of charge.
- If for any reason a wedding list is cancelled the following charges will be levied:
- Cancellation before any presents are bought - £75.00
- Cancellation once presents have been bought - £75.00 plus 10% of the
value of the presents bought at the time of notification. Notification must be received in writing. - WPD reserves the right to increase prices charged to purchasers from the price stated at the time the wedding list is booked if the price of supply of goods increases in that period.
Cancellation
- A Guest, or in the case of Online Shopping, the Purchaser (as defined below) shall have seven working days from the date of delivery of a product (the "Cooling Off Period") in which to cancel such an order.
- Such cancellation may be effected in writing to WPD by email to office@weddingpresentsdirect.co.uk, by fax to 01488 680 702 or otherwise in writing to WPD sent to Unit 2, Standen Manor Farm, Hungerford, Berkshire RG17 0RB.
- If an order which has been paid for is cancelled during the Cooling Off Period, WPD shall reimburse the bride and groom or the Purchaser the cost of the item purchased and, if appropriate, delivery charges that have been paid for, within 30 days of cancellation.
- In the event of a cancellation, the bride and groom or the Purchaser, as appropriate, shall return the goods to WPD in the same condition as delivered to them within 30 days of such cancellation.
Delivery of Wedding Gifts
- Delivery to UK mainland addresses is free for all wedding lists once the total retail value of presents sold from that list has exceeded £2,000. All other mainland deliveries are charged at £25.00 per delivery.
- WPD are delighted to arrange packing, transportation and insurance for deliveries outside the UK mainland and will charge this at cost.
- WPD offers free storage of wedding presents for up to six months from the date of the wedding ("Present Storage"), after which storage charges apply (such charges being the cost to WPD of such storage) ("Default Storage "). In the case of Default Storage, unless the bride and groom have made arrangements for removal or delivery of the goods in such a six month period, at the end of such period, the goods may be sold by WPD and WPD shall on the request of the bride and groom account for the net profit on such goods calculated by WPD acting reasonably.
- Please note that some items, especially china, linen and some handmade gifts can have delivery times of up to six months from the date of ordering. WPD will do its best to minimize such delays and try to keep the bride and groom as informed as possible.
- Luggage for honeymoon: WPD will only order luggage before it has been purchased from a wedding list with the express written request of the bride and groom. While WPD will do all it can to get the luggage to the bride and groom before the honeymoon, a written request in itself does not guarantee delivery.
- If WPD cannot gain access to the stated delivery address at the agreed times [they shall contact the bride and groom to arrange a revised delivery date and if access cannot be gained on that occasion], save where the goods have already been subject to Present Storage (in which case the goods shall go into Default Storage), the provisions for Present Storage shall apply.
- Dates for delivery are estimates only and there shall be no liability for late delivery.
- WPD may effect delivery by such means as they see fit.
Online Shopping
- WPD shall use reasonable endeavours to deliver items purchased within five business days of purchase, within the UK.
- Deliveries shall be charged in accordance with the delivery charges noted on the WPD website on the date of purchase.
- Dates for delivery are estimates only and there shall be no liability for late delivery.
- WPD may effect delivery by such means as they see fit.
Risk
- For Online Shopping all products remain the property of WPD until delivery at which point risk transfers to the Purchaser.
- Risk in items purchased passes to the bride and groom on delivery to the delivery address stated when the list is set up or such other address as is notified to WPD in writing.
General
- Personal details: In order to offer the high level of personal service that has become the hallmark of WPD, it is necessary for the company to hold a certain level of personal data. This data is used exclusively in the management of its wedding lists and Online Shopping service. WPD will not sell, rent or pass on this information to a third party.
Limitation of Liability
- If for any reason WPD are unable to fulfil a particular order, a full cash refund or suitable alternative will be offered to the bride and groom or the Purchaser as appropriate.
- Copies of the wedding list will be forwarded to the bride and groom. It is the responsibility of the bride and groom to check the list carefully because items cannot be exchanged or returned once ordered by WPD unless damaged, faulty or incorrectly supplied or in accordance with the cancellation provisions noted herein.
- WPD gives no warranty as to the suitability or quality of the products it supplies, to the extent permitted by law.
- WPD accepts unlimited liability for death or personal injury resulting from its negligence. The following paragraphs do not apply to such liability.
- WPD shall have no liability for damaged or faulty goods unless notification of such damage or fault has been made to WPD within seven days of delivery.
- WPD shall have no liability howsoever arising and whether in contract, tort or otherwise for any damage caused by the negligence of the bride or groom, a Guest, the Purchaser or any third party or as a result of the particulars of any guide or manual provided with any product not being followed.
- WPD shall have no liability for any loss or damages claimed for loss of enjoyment.
- In addition to the limitations noted above, WPD's liability to the bride and groom, a Guest or a Purchaser, in contract, tort (including negligence) or otherwise in relation to these terms and conditions is limited to the amount that it is able to recover pursuant to insurance it has in place in respect of the particular liability.
- Each provision of these terms and conditions, excluding or limiting liability, operates separately. If any part is held by a court to be unreasonable or inapplicable, the other parts will continue to apply.
Acceptance of Terms and Conditions
- We have read and understand these Terms and Conditions and agreeing to compile a wedding list with WPD [and/or agreeing to purchase goods from WPD] confirm our agreement to the same and confirm that these terms and conditions represent the entire agreement between us in relation to their subject matter and replaces and cancels any prior arrangements.
Governing Law
- These Terms and Conditions shall be construed in accordance with and governed by the laws of England whose courts shall have exclusive jurisdiction.
